Your Design World’s Terms of Service

General TOS:
• Our work will begin after ALL required items are received: Signed Proposal, signed Terms of Service, Signed Credit Card Authorization Form, Login Credentials, Approval of Project Scope, AND Client Questionnaire.
• All work is “as is” and designed to be compatible at the time the projects are launched live.
• If client requests that Your Design World pay for the cost of ad campaign budgets (EX: Google pay-per-click ads or Facebook ads) on behalf of the client than Your Design World will include this cost within their monthly invoices (for reimbursement) plus a 10% processing fee.
• A late fee of 10% will be assessed to all payments that are over 14 days past due. Should your credit card number change or be declined please provide us with the new credit information within 2 weeks of our request to avoid late fees.
• Management fees and retainers are paid up front each month.
• Invoices & Receipts are sent electronically.

Local SEO
• Client is paying Your Design World for our time and expertise. We spend a minimum of 3-5 hours per month optimizing each campaign, primarily creating directory listings and citations. We also assist in generating reviews, monitoring ranking positions, optimizing your Google+ business listing and in some cases conducting onpage optimization. All these factors are meant to increase your online presence promote your business and increase your Google+ business listing’s exposure.
• Results are centered around your geographic location.
• We do not guarantee specific keyword phrases and ranking positions. We optimize in an effort to target relevant and desired local search terms gathered from the client questionnaire, your website and Your Design World’s target market evaluation.
• Reported results may vary. Results are dependent on where Google interprets the user’s physical location to be (based on their IP address)
• We will not begin billing your recurring monthly fee until 2 weeks after we charge the initial setup fee. During the setup phase we will confirm that your Google+ Business Listing Page has been verified and properly indexed. In the rare case that we encounter issues verifying your account we will let you know prior to beginning your billing cycle so we can determine if we will be able to continue optimizing your account.
• Google may change its policies and algorithm at any given time and Your Design World cannot be held responsible for how those changes may affect your rankings. In addition, in we cannot control the competition’s use of similar SEO tactics so we cannot guarantee rankings or ranking positions.
• All our services are paid in advance for the month ahead.
• Your Design World does not require a contract outside of a 30-day cancellation notice. Your Design World will continue conducting SEO on a monthly basis until notified otherwise.
• Should client decide to cancel client must formally notify Your Design World via email at admin@YourDesignWorld.com and state that they would like to stop services. Your Design World will confirm and Your Design World will continue optimizing the campaign until the end of the billing cycle. If the cancellation notice within 48 hours of the next billing cycle the client may be billed in which case we will conduct our services for that month. Your Design World does not provide refunds for payments that have been processed.
• Your Design World cannot be held responsible for a client’s account being removed from Google’s results for any unforeseen reasons. If the account disappears from Google’s search results Your Design World will stop the monthly fee and will help the client work through the process of getting the Google account re-established. Your Design World will not conduct ongoing optimization during the time the account is not displaying in the SERP’s. We will monitor and attempt to re-establish results for up to 3 months at no charge after which point we will provide the client with best practices and tactics to work on re-establishing results on their own through Google’s help support forums.

Organic SEO:
• Our optimization efforts are intended to increase your website’s organic rankings for relevant Geo modified search terms through the process of on and off page optimization.
• Google may change its policies and algorithm at any given time and Your Design World cannot be held responsible for how these changes may affect your rankings.
• Your Design World suggests a minimum 6-month commitment in order to allow sufficient time for the results of our efforts to take effect and make an impact.
• Your Design World has a 30-day cancellation policy and Your Design World will continue conducting SEO until notified otherwise.
• Client is paying Your Design World for our time and expertise. A dedicated account manager will spend a set number of hours (determined in your proposal) working on your campaign. The work we do contributes towards increasing your online presence and work in our favor to promote your business and increase your Google rankings. That being said we have no control over the search engines changing their algorithm and we do not have control over the competition therefore we cannot guarantee rankings or ranking positions.

Design & Development:
• Client is to supply all images, logo designs and content before the project is initiated.
• Design comps typically take 4-7 business days after all requested information and content is provided.
• Client provides final feedback and after approval, a live comp is coded and developed.
• Approval of the Round 2 Design comp is the client’s commitment and understanding that the design for the project has been finalized and major design changes outside the scope of the project will be charged at our hourly rate of $125/hr.
• Final payment is due before the final design is launched live.
• Social media design comps will be based off your company’s branding and logo design and color-scheme.
• The project will not begin until all content, layout instructions, signed proposal, and deposit are received from the client.
• Your Design World cannot be held responsible for any changes in formatting, compatibility and updates with a website after the product is complete and there is no webmaster retainer contract with the client.
• Your Design World cannot be held responsible for any changes in formatting and compatibility with the different social media channels.
• All work is “as is” and designed to be compatible at the time the designs are launched live.
• Your Design World ensures browser compatibility with Internet Explorer versions 8 and greater, Safari, Chrome & Mozilla Firefox at the time the projects are launched live.
• Your Design World ensures basic mobile phone compatibility with iPhones and Androids at the time the projects are launched live.

Social Media Management:
• Management fees are paid up front each month.
• Invoices will be issued monthly and are due upon receipt.
• Your Design World will email content to client 2-3 days prior to the start of the next month’s campaign. Client’s lack of response within 48 hours indicates approval.
• Client shall inform Your Design World in writing if any portion of any material or information created by Your Design World is incorrect or confidential. Your Design World is not responsible for any incorrect or confidential material posted on social media channels that was sent to client for prior approval.
• After the duration of client’s contractual obligation, Your Design World will continue to manage client’s social media campaign on a month-to-month basis unless otherwise agreed upon.
• Termination of campaign must be received in writing at least 14 days before the next billing cycle. Failure to do so may result in a partial charge for the content and strategy work that has already been put in to the following month.
• Additionally, early termination of a campaign will result in a charge of any set-up fees that were waived at the beginning of your campaign.
• Any additional time spent on client’s campaign (outside the scope of the proposal) will be charged at the agreed upon established hourly rate.
• Your Design World has no control over the social media platforms changing their user interface or terms of service, and cannot be held responsible for unforeseen changes that may be detrimental to a client’s campaign.
